Today marks a monumental day for millions of hardworking Americans as President Joe Biden officially signed the Social Security Fairness Act into law. This landmark legislation, H.R. 82, repeals the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO) provision, ensuring a fairer Social Security system for public employees who have long faced unjust benefit reductions.
The journey of the Social Security Fairness Act has been a testament to the power of persistent advocacy and bipartisan cooperation. The House of Representatives passed H.R. 82 on November 12, 2024, with a resounding roll call vote of 327-75-1. The Senate followed suit on December 21, 2024, passing the bill by a decisive 76-20 margin. Both chambers demonstrated a shared commitment to righting the inequities that have affected retirees for decades. With the President’s signature, the repeal applies to benefits payable after December 2023, restoring dignity to those who dedicated their careers to public service.
A History of the Social Security Fairness Act
The Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO) were originally enacted in the 1980s to prevent “double-dipping” in retirement benefits. However, these provisions disproportionately penalized public servants who contributed to both Social Security and non-covered pensions. For decades, teachers, firefighters, police officers, and postal employees faced reduced or eliminated Social Security benefits, creating financial hardship for many retirees. The Social Security Fairness Act sought to address these injustices by repealing these provisions outright, restoring equity to the system.
The passage of this act is the second major legislative victory for NAPS in recent years, following the successful enactment of the Postal Reform Act. These achievements underscore the importance of relentless advocacy and the strength of our collective voice.

Benefits of H.R. 82 for Retirees and Their Families
The repeal of WEP and GPO under H.R. 82 represents transformative benefits for both current and future retirees:
- Restoration of Fair Benefits for Current Retirees: Many retirees who worked in public service roles, such as postal supervisors, teachers, and first responders, will finally see their full Social Security benefits restored. The WEP often reduced Social Security payments for individuals who also received a pension from non-covered employment, while the GPO cut spousal and survivor benefits—in some cases, eliminating them entirely. With H.R. 82, these unfair reductions are eliminated, providing financial relief and security to those who earned their benefits through years of dedicated service.
- Improved Financial Security for Future Retirees: For future retirees, the repeal ensures that they can plan their retirement with confidence, knowing their Social Security benefits will not be unfairly diminished. This change will encourage more individuals to consider careers in public service without the fear of losing hard-earned retirement benefits.
- Enhanced Support for Spouses and Survivors: The GPO’s repeal is particularly impactful for spouses and surviving family members. Under the GPO, many spouses were left with little to no Social Security benefits following the death of their partner. H.R. 82 restores these critical benefits, ensuring surviving spouses and families receive the support they need during challenging times.
- Strengthening Public Service Recruitment and Retention: By eliminating the disincentives created by WEP and GPO, the Social Security Fairness Act helps public institutions attract and retain talented employees. This is a long-term investment in the quality and stability of public services, from education to emergency response.

While we celebrate this victory, our work is far from over. NAPS is actively advocating for the passage of additional critical legislation, including:
- The Postal Supervisors and Managers Act (H.R. 594)
- The Postal Employee Appeal Rights Amendment Act (H.R. 595)
- The Postal Police Reform Act (H.R. 3005 and S. 3356)
These bills aim to strengthen the rights, protections, and operational capacities of postal supervisors and employees, ensuring a fair and efficient postal system for years to come.
